1 QUOTATIONS — All quotations for any work are exclusive of VAT where applicable, are valid for a period of thirty days only and are subject to sight of copy, artwork or disk supplied and are subject to change according to material fluctuations.
2 PAYMENT — All goods shall become due for payment upon completion or delivery whichever is the earlier. All invoices are strictly 30 days from date of invoice unless agreed in writing by New Moon Facilities Management Limited (from this point referred to as New Moon). New Moon reserves the right to charge interest 4% above Natwest Bank base interest rate in respect of all overdue accounts for the complete time of the debt. Any and all goods supplied by New Moon shall be subject to charge.
3 TITLE OF GOODS — All goods supplied by New Moon shall remain the property of New Moon until all outstanding invoices are paid in full. New Moon reserves the right to remove any and all goods supplied by New Moon after seven days notice if outstanding invoices remain unpaid.
4 DELIVERY — All quotations are inclusive of one delivery, any and all additional deliveries will be subject to additional costs.
5 ADDITIONAL CHARGES — Should New Moon incur any additional costs, such as overtime, an additional charge shall be made.
6 ARTWORK AND ORIGINATION — Any and all artwork and origination carried out by New Moon is chargeable. Wherever possible the origination will be included in the original quotation and additional charges for work to be carried out will be notified in writing before work commences.
7 AUTHORS CORRECTIONS — Any and all authors corrections after initial proofing, whether they be of style, content or material changes will incur additional charges.
8 PROOFS — All quotations include an initial pdf proof, hard copy proofs and subsequent proofs after any corrections may be subject to additional charge. All work must be approved by the customer upon completion. New Moon will accept no claims for any errors in proofs, which are passed for production by the customer.
9 QUANTITIES — New Moon will make every effort to ensure all deliveries are as per customers instruction, however all quotations are subject to a 5% variation over and under, and invoice values will be amended accordingly.
10 CLAIMS AGAINST GOODS AND SERVICES — Any and all claims against goods and services for whatever reason must be received in writing by New Moon within 14 days of date of invoice.
11 MATERIALS AND GOODS SUPPLIED — New Moon will take every care to ensure that all goods supplied, be they material, disks, copy, samples or any and all other goods, will be held in safe and secure conditions. However any and all goods held on behalf of the customer are at the customer’s risk and must be insured accordingly.
12 THIRD PARTY LIABILITY — New Moon will accept no claims or liability what so ever arising from third parties falling to carry out the instructions of New Moon.
13 LIBELLOUS OR ILLEGAL MATTER — New Moon will under no circumstances produce any work which in its opinion has a libellous content or is in any way illegal, and will in no way what so ever accept any claim for any items which have been produced and which are later to be found to have illegal or libellous content, or infringe copyrights, designs or patents of third parties.
14 FORCE MAJEURE — New Moon will make every effort to ensure that all goods and services it supplies are carried out according to the customers instructions, but can in no way be libel or accept any claims for variation as a result of Strike Action, War, Flood, Fire, Structural Damage, Act Of God, or any other unforeseen incident beyond its reasonable control.
